General Terms and Conditions of LIVING

§1 Validity for entrepreneurs and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in their version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity (§ 13 BGB).

§2 Conclusion of a contract, storage of the contract text

(1) The following regulations on the conclusion of the contract apply to orders placed via our online shop https://www.livingforme.de/.

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but merely an non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following regulations apply: The consumer makes a binding contractual offer by successfully completing the order procedure provided for in our online shop.

The order is placed in the following steps:

Before submitting the order, the consumer can return to the website where the customer's data is recorded and correct input errors by pressing the "Back" button contained in the internet browser they are using, or cancel the order process by closing the internet browser. We confirm receipt of the order immediately by an automatically generated email ("order confirmation"). With this, we accept your offer.

(5) Storage of the contract text for orders placed via our online shop: We store the contract text and send you the order data and our general terms and conditions by email. You can also view the general terms and conditions at any time at https://www.livingforme.de/pages/agb. You can view your past orders in our customer area under "Your Account".

§3 Prices, shipping costs, payment, due date

(1) The prices stated include the statutory value-added tax and other price components. Any shipping costs are added.

(2) The consumer has the option of payment by prepayment, PayPal, credit card (Visa, Mastercard, American Express). You can find more information on this under the following link: Payment

(3) If the consumer has chosen payment by prepayment, they undertake to pay the purchase price immediately after conclusion of the contract.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items offered by us are immediately ready for dispatch. Delivery will take place here within 14 working days at the latest. The period for delivery begins, in the case of prepayment, on the day after the payment order is issued to the bank instructed to make the transfer, and for all other payment methods, on the day after the conclusion of the contract. If the end of the period falls on a Saturday, Sunday, or public holiday at the place of delivery, the period ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the sold item passes to the buyer only upon handover of the item to the buyer, even in the case of a mail-order purchase.

§5 Retention of Title

We reserve ownership of the goods until the purchase price has been paid in full.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, other than the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us

by means of a clear statement (e.g. a letter sent by post, fax, or e-mail) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, which is not mandatory.

Consequences of withdrawal

If you withdraw from this contract, we must repay you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you chose a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which the notification of your withdrawal from this contract was received by us. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You bear the direct costs of returning the goods. The costs are estimated at a maximum of approximately 39 EUR.

Financed transactions

If you have financed this contract with a loan and you withdraw from the financed contract, you are no longer bound by the loan agreement either, if both contracts form an economic unit. This is particularly to be assumed if we are simultaneously your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already flowed to us when the withdrawal or return becomes effective, your lender shall assume our rights and obligations from the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. The latter does not apply if the present contract concerns the acquisition of securities, foreign currencies, derivatives or precious metals.
If you wish to avoid a contractual commitment as far as possible, withdraw both contract declarations separately.

§12 Exchange and Complaint

§13 Shipping

Orders received by us on working days before 10:00 AM will be shipped to you within a maximum of 4-6 working days, provided the goods are in stock. Standard parcels with a volume weight up to 31.5kg and a girth measurement up to 300cm will be delivered to you by DPD within 4-6 working days. Separate shipping regulations apply to freight forwarding goods with a girth measurement over 300cm and hazardous goods.
